By becoming a member of ApnaCircle, you agree to comply with the present terms of use. If you do not accept these general conditions of sale, you must not register with ApnaCircle. Subscription to one or several services together with the use of the present site implies full and complete acceptance by the member of the present conditions.

To be a member of ApnaCircle, you must be an adult and fill in all the mandatory fields on the registration forms.

Once registered, you will be given one or several personal and confidential login(s) and password(s). These must not be communicated to or shared with third parties. In no case will ApnaCircle be held responsible for the loss of your usernames and/or passwords.

In the event that you misuse the login and authentication logins/passwords, ApnaCircle reserves the right to terminate your account without prior notice. You will be solely liable for the use of the login and authentication logins/passwords by third parties or for actions or statements made through your account, whether fraudulent or not. You hereby agree indemnify ApnaCircle against any claim, fine or damages resulting from such misuse.

ApnaCircle does not have the means to check the identity of people registering for its services. ApnaCircle will not be held responsible for any alleged or actual identity theft. If you think that someone is using your account or your identity, you must inform us immediately by post at the aforementioned address.

When a member wishing to invite a contact provides ApnaCircle with their email address, he warrants having received this friend's prior consent (actual or implied) authorizing their data to be used by ApnaCircle. It is solely responsible for the consequences of the transmission to ApnaCircle of the coordinates of their contact(s).

ApnaCircle reserves the right to deactivate the accounts of members who have not connected to the service for a period of 6 (six) months or more.

In accordance with relevant distant selling legislation, you are informed that you are entitled to a period of seven calendar days, from the date of subscription, to exercise your right of withdrawal without penalty and without cause. However, the right of withdrawal may no longer be exercised once you have accessed the features associated with this service.

Once registered, you will be granted access to ApnaCircle's services. The price and payment terms and conditions for the different services are available on the ApnaCircle site during introduction to and use of the services you wish to subscribe for.

By using ApnaCircle, you specifically agree to observe the following rules:

• To comply with the applicable laws in force and to respect the rights of third parties as well as the present provisions.
• To deal in good faith with ApnaCircle and other users.
• To respect the intellectual property of ApnaCircle, other users and third parties.
• To use ApnaCircle features only for their intended purpose.
• Not to overload the ApnaCircle service. Specifically, not to load more than 1,000 ApnaCircle pages per day without our written consent.
• Not to send ApnaCircle or other users any data your private information which if disclosed could be prejudicial to you.
• Not to distribute data or contents that are untrue or misleading.
• To not share information or contents of a defamatory, imsulting, obscene, offensive, violent, provocative, political, racist, xenophobic nature, or in general, share anything which goes against ApnaCircle's objectives, laws, rules or good nature.
• Not to distribute data or contents the effect of which is to diminish, disorganize, prevent the normal use of ApnaCircle, disrupting and/or slowing down the normal circulation of communications between members.
• Not to post job ads or advertisements outside of the Career space (Groups, Ads, News, etc.). If you would like to post a job ad, Jobs section is reserved for this purpose.
• To not participate directly or indirectly in a network which aims to implement practices comparable to "the snow ball effect" mentioned in sections L 122-6 and L 122-7 of the French consumer code.
• Not to take part directly or indirectly in a network designed to implement practices similar to networking marketing (MLM). Recruiting Independent Door-to-door salespersons is also prohibited if used to develop such a network or leads to other similar practices.

In case of infringement by a member of one or more of these rules, ApnaCircle reserves the right to terminate the contract unilaterally and without prior notification, to block the account(s) of the members in question, to automatically delete litigious messages, to prevent the posting of all or part of a member's profile, and/or to block their access to all or part of the services, on a temporary or permanent basis, without any compensation. In any case, no reimbursement of sums paid by the user shall be made following the permanent deletion of an account by ApnaCircle.

ApnaCircle shall not be held responsible for any false or misleading statements made by a member. ApnaCircle disclaims all responsibility related to any communications between ApnaCircle members, on ApnaCircle or during meetings between members and/or non members, as a result of the use of its site and services.

The ApnaCircle site respects your right to privacy and has completed the relevant Data Protection registrations required in the United Kingdom.

ApnaCircle shall have the sole authority to decide whether to allow or remove content if a campaign does not respect the above principles. ApnaCircle shall have no liability in respect to any such action or inaction.

The data liable to be collected on ApnaCircle is exclusively intended to help you enhance your professional network.

The ApnaCircle site respects your right to privacy and has complied with the relevant Data Protection registrations in the United Kingdom.

Users may make certain information or contents (including but not limited to photos and videos) available on the website. Follow the five steps to delete your ApnaCircle account at any time without having to provide any notice.

1. Connect onto the site and insert your email address to log on.
2. Click 'Preferences' at the top of the page.
3. Select 'My Account'.
4. Click on 'Delete my account' next to 'I would like to delete my ApnaCircle account'.
5. Confirm to delete your profile.

The deletion of you account and of your personnel details will be effective within 24 hours. As a result of this, you will not be entitled to a refund for the remainder of your subscription.

Your data will not be passed to third parties.

In the event of a breach on your part of the present terms of use, ApnaCircle reserves the right to suspend or terminate your account without notification or compensation.

This termination shall occur without prejudice to all damages and interests that may be claimed against you by ApnaCircle or its assignees and legal representatives as remedy for any damages incurred as a result of such failures.

The information provided by a member must be accurate and true. The consequences of its disclosure on your life and/or on that of other members are your exclusive responsibility. You waive the right to any legal action against ApnaCircle, and specifically on the basis of potential damage to your right of personal portrayal, to your honour, to the intimacy of your private life, resulting from the distribution or disclosure of any of your information.

ApnaCircle cannot be held liable for the accuracy or inaccuracy of information and content provided by other members, visitors to the site and/or yourself. Likewise, ApnaCircle cannot be held responsible for content distributed by a member that may infringe the rights of one or several other members.

The quality of the site www.apnacircle.com, demanded by ApnaCircle and its members is in line with a certain respect for an ethic involving members’ behaviour, rights of third parties and rules and regulations which have been implemented. With this demand for quality and individual responsibility in mind, ApnaCircle gives each member the opportunity to report and provide evidence (photographic, textual) of any behaviour they believe to be going against ApnaCircle's image, objectives and good nature, the rules and regulations in place and rights of third parties. Members must recognize and accept that their behaviour and any information they provide could be the subject of an 'abuse report' by other members and consequently an investigation by ApnaCircle. If hypothetically, this ‘abuse report’ or investigation demonstrates a violation by a member of the rules and regulations in place or of his contractual obligations, the terms in the Conditions of Use, notably in article 5 - "Termination of account" will be applied.

In the event that the responsibility of ApnaCircle is alleged due to failure by a member to meet their obligations under the terms of the law or under the current terms of use, the aforementioned member promises not to hold ApnaCircle responsible for any judgment against their, this guarantee covering both fines that might be paid as well as attorney's fees and legal costs the member may have to pay.

You must possess the skills, hardware and software required for Internet use and acknowledge that the features and limitations of the Internet do not make it possible to guarantee the security, availability and integrity of Internet data transmissions.

ApnaCircle does not guarantee that the services will function without any interruption or error. Specifically, their operation may be momentarily interrupted for reasons of maintenance, update or technical improvement, or for the upgrade their content and/or presentation.

Where possible, ApnaCircle shall inform its members ahead of time of any maintenance or update operation. You waive the right to hold ApnaCircle responsible for the operation and exploitation of the www.apnacircle.com site.

Likewise, ApnaCircle will not be held responsible in the event of failure, access denial, or poor conditions of use of the ApnaCircle site due to inadequate equipment, to interruptions attributable to the member's access provider, to Internet network congestion, and/or any other reason out of ApnaCircle's control.

ApnaCircle shall have no liability in whole or in part for indirect losses including, but not limited to, loss of data (including copies) or back-ups that you could have made.

ApnaCircle reserves the right at any time to change or modify the pages of its website, the services, prices and/or terms of use applicable thereto.

These modifications shall become effective as soon as they are put online on the www.apnacircle.com site and will not constitute a cause for termination by a member of their ApnaCircle subscription.

These terms and conditions are governed, interpreted and applied according to French law, and the version in the French language will be used in the case of any dispute or claim arising from the meaning of any term or these terms and conditions of sale and use. Subject to applicable law, the courts of the place of the registered office of ApnaCircle shall have exclusive jurisdiction for any claim or dispute arising from these terms and conditions including, but not limited to, their intrepretation, validity, execution, termination and/or the consequences thereof.
